A Will Contested From Prison, for Almost a Year

August 14, 2026 Maria V. Primushko 1 min 1 sec video

A will contested from prison. He has nothing but time, access to a law library, and no reason to stop. Nearly a year of motions and appeals. That is the cost of not having things properly written down, and a will alone does nothing for incapacity while you are still living.

What I said in this clip, lightly edited for readability.

The guy has nothing to do. He has all the time in his life. He has a library, he has resources. And it's been almost a year already. He just writes motions, appeals, and extends the process. That's the cost of not having everything written down.

Also, a will doesn't provide for your incapacity. God forbid something happens to you and you cannot decide for yourself and act on your own behalf: writing checks, talking to insurance, talking to doctors. Then it will call for a living probate, because your loved one will have to file for conservatorship and open a living probate with the court. And we'll talk about it a bit later. It is a long and expensive process.
