What to Do After a Car Accident in California

No one is thinking clearly in the minute after a crash. That is exactly why a short, calm list helps. Read these once now, keep the wallet card below in your glovebox, and walk your whole family through them, especially any new driver. The goal is simple: stay safe, stay calm, and protect your health and your claim.

  1. Stop and get to safety.

    Never drive away from a crash you were part of, even a minor one. If the cars are drivable and sitting in traffic, move them to the shoulder. Turn on your hazard lights, and get yourself and any passengers to a safe spot away from moving cars.

  2. Check for injuries and call 911.

    If anyone is hurt, or you are not sure, call 911. In California you are required to notify police when a crash causes injury, death, or major property damage. Asking for help is always the right call.

  3. Do not admit fault, and keep it brief.

    Be polite, but say as little as possible about who caused the crash, even a reflexive "I'm sorry." Fault is decided later from the facts. Do not argue, and do not accept cash to keep it off insurance.

  4. Exchange information.

    Get the other driver's name, phone number, insurance company, policy number, vehicle, and license plate, and give the same. If they refuse or leave, do not chase them. Note the plate and a description for the report.

  5. Photograph everything.

    Both vehicles, all damage, the license plates, the wider scene, traffic signs and signals, skid marks, and any visible injuries. More photos are always better than fewer. A short video of the scene helps too.

  6. Find witnesses.

    If anyone saw what happened, politely ask for a name and phone number before they leave. An independent witness can settle a fault dispute later.

  7. Get medical care, even if you feel fine.

    Adrenaline hides injuries. Neck, back, and head symptoms often appear a day or two later. See a doctor promptly, and keep going to every appointment. Gaps in treatment are the first thing an insurer uses to shrink a claim.

  8. Notify your insurer, carefully.

    Report the crash as your policy requires, but stick to the basic facts. You are not obligated to give the other driver's insurer a recorded statement, and you should be cautious before doing so.

  9. Call a lawyer before you sign or settle.

    If anyone was injured, or the other driver was uninsured, a short, free conversation protects your options. Early offers are almost always low, and some deadlines are easy to miss.
